These Terms govern your use of Mediscribe AI. Please note that Mediscribe is an AI administrative writing tool; as the licensed clinician, you remain fully and solely responsible for reviewing and confirming all clinical notes before adding them to patient electronic health records.
1. Introduction & Acceptance of Terms
Welcome to Mediscribe AI. These Terms of Service ("Terms") govern your access to and use of our ambient clinical intelligence and AI scribing software services ("Service", "Software", or "Platform").
By creating an account, registering for the Service, signing an agreement referencing these Terms, or accessing our platform, you agree to be bound by these Terms in full. If you are accepting these Terms on behalf of an NHS Trust, clinic, hospital network, or other entity, you represent and warrant that you have the legal authority to bind that entity to these Terms.
If you do not agree to all of these Terms, you must not access or use our ambient clinical assistant software.
2. Scope of Service & AI Scribing technology
Mediscribe AI provides an AI-powered clinical transcription and documentation assistant. The Service captures ambient audio conversations between clinicians and patients during consultations, transcribes the voice input, and uses natural language processing (NLP) and large language models (LLMs) to generate structured clinical summaries, SOAP notes, referral letters, and action plans.
The service is designed to reduce administrative documentation burdens. You acknowledge that our AI technology is inherently probabilistic and that the outputs generated may sometimes contain inaccuracies, omissions, or misinterpretations.
3. Clinical Responsibility & Medical Disclaimer
IMPORTANT MEDICAL DISCLAIMER & CLINICIAN RESPONSIBILITY:
Mediscribe AI is NOT a medical device. The platform does not practice medicine, provide clinical diagnostics, make treatment decisions, or issue medical advice. The clinical notes, summary documents, and materials generated by the Software are draft suggestions provided solely for administrative convenience.
You, as the licensed healthcare professional, retain full, sole, and exclusive clinical responsibility for the accuracy, completeness, and appropriateness of any patient clinical notes, medical records, or documentation before they are committed, saved, or uploaded into an Electronic Health Record (EHR/EPR) system or used for patient care decisions.
You agree to carefully review, edit, correct, and verify every output generated by the Service prior to finalizing the consultation documentation. Mediscribe AI is not liable for any clinical errors, medical malpractice, or patient adverse events arising from uncorrected or unreviewed notes.
4. Patient Consent & Recording Compliance
Before initiating any voice recording or ambient consultation capturing through Mediscribe AI, the clinician MUST obtain the patient's explicit consent (or the consent of their legal guardian/representative, where applicable) in accordance with local medical standards, professional ethics, and data protection laws.
You agree and warrant that you will:
- Inform the patient that their conversation will be captured securely by an AI-powered transcription tool to help write clinical documentation.
- Clarify that the audio is encrypted, and will not be shared or used for third-party public marketing.
- Immediately pause or terminate the recording if the patient requests to opt-out or expresses discomfort.
- Comply fully with your clinic's, hospital's, or NHS Trust's internal policies regarding patient audio consent.
5. Data Protection, NHS DSPT & Security Standards
We take patient data protection and security with the utmost seriousness. Mediscribe AI is engineered to comply with NHS Data Security and Protection Toolkit (DSPT) standards, the UK General Data Protection Regulation (UK GDPR), the US Health Insurance Portability and Accountability Act (HIPAA), and the UK Data Protection Act 2018.
Unless otherwise configured under a custom enterprise SLA with an NHS Trust or healthcare facility, we process and store patient data according to the following strict guidelines:
- Mã hóa đầu cuối (End-to-End Encryption): Consultation data and temporary audio are encrypted in-transit (HTTPS/TLS) and at-rest (AES-256).
- Zero-Retention Policy options: To support patient confidentiality, audio streams can be deleted immediately upon successful notes generation. No permanent audio logs are retained on our servers without explicit Trust compliance configuration.
- Strict Training isolation: We strictly isolate customer data. Patient consultations and clinical documentation are NEVER used to train public third-party AI models.
6. Subscriptions, Fees & Account Management
Access to certain premium tiers and organizational features of Mediscribe AI requires a paid subscription. You agree to provide accurate, complete, and current billing information. All fees are non-refundable unless specified otherwise in writing.
For enterprise accounts (e.g., NHS Trust contracts, clinic licenses), invoicing and payment schedules will be determined by the separate master commercial agreement signed by your organization.
You are responsible for keeping your account credentials, passwords, and security tokens confidential. Any suspicious activity on your account must be reported to support immediately.
7. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Mediscribe AI, its affiliates, directors, employees, or suppliers be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, medical malpractice, clinical error, patient records mismatch, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the platform.
Our liability under any circumstances is strictly capped at the total fees paid by you (or your healthcare institution) to Mediscribe AI for the specific services in the twelve (12) months preceding the event giving rise to liability.
8. Governing Law & Contact Details
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any legal disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of England.
